Epifeast Inc. (“Epifeast”, “Company”, “We”, “Our” or “Us” and their connotations, which terms may include reference to our affiliates, successors-in-interest and permitted assigns) owns and operates a website (URL: https://www.eatwithnymble.com/) and controls its social media pages (including but not limited to those on Instagram, Facebook, LinkedIn, and Twitter) (hereinafter collectively referred to as “Platform”).

Our Platform primarily acts as a self-contained program and software which works in connection with Our smart robot sous chef (“Product”) and integrates with Our website to prepare food in accordance with the recipes subscribed to by Our customers. Additionally, Our Platform provides a gateway to purchase Our Product.

This Privacy Policy explains how and when Epifeast collects information from its end users or the visitors to the Platform, which may include their personal information (“Personally Identifiable Information”) and health-related information (“Personal Health Information”), how We use such information, and the circumstances under which We may disclose such information to others. This Privacy Policy applies to (a) users who visit Our website; (b) users signing up to Our Platform; (c) users subscribing to Our newsletters; or (c) users using Our Product (hereinafter collectively referred to as “You”).

This Privacy Policy shall be read along with our Terms of Use (“Terms”) set out at https://www.eatwithnymble.com/terms-of-service. Any capitalized term used but not defined in this Privacy Policy shall have the meaning attributed to it in the Terms.

Consent

You will be deemed to have read, understood and agreed to the terms as provided in this Privacy Policy. By granting your assent to this Privacy Policy, You provide consent to such use, collection and disclosure of your Personally Identifiable Information and/ or Personal Health Information as prescribed in this Privacy Policy.

Information collected by Us

Contact and order fulfilment information: We collect your contact information (such as name, email address, phone number and location) when You sign up on Our Platform.

Billing and payment information: If You make a purchase on Our Platform, We collect your billing details such as residential address, email address and financial information including but not limited to (i) your credit/ debit card details; (ii) bank account details; and (iii) such other information that may be required in order to process the billing.

Personal Health Information: During the course of your use of Our Product, you may provide Us with information regarding your health (including but not limited to allergies, blood sugar levels, cholesterol levels). We collect such information in order to improve the performance and efficiency of Our Product, in order to serve You better.

Information relating to your food and dietary preferences: When You use Our Product, We collect information regarding the recipes You prefer and the ingredients You use. This helps Us understand your food and dietary preferences which in turn helps us improve your experience with our Product and/ or Platform.

Usage information: When You access or use Our Product and/ or Platform, We automatically collect and receive usage information (e.g., when you view or search the website). We also collect data about the devices You use to access the Platform (e.g., IP addresses, device type, mobile network information, unique device identifier, operating system, browser type, application version, pages visited, and referring web pages). This information is sometimes called “log data” and helps Us improve and customize the Platform. This information is generally non-identifying in nature, but if We associate it with You as an identifiable person, We will treat it as Personally Identifiable Information.

Your choices; Opt-out; Third-party tracking

If You have submitted information to Epifeast and would like to have it updated, corrected, or removed, please contact Us using the contact information provided below. We will use reasonable efforts to comply with your request. However, We may not be able to allow You to update, corrector remove certain information in certain circumstances, for example if it contains information of other persons, or for legal reasons. In such cases, We will provide You with a reasonable explanation of why it is not possible.

If You receive any promotional email communication from Us, You will be given the option to“ unsubscribe” from receiving further email communications from Us at any time. (1) California “Shine the Light” law

(2) Do not track

As per California law, CalOPPA (California Business & Professions Code Section 22575(a)), it is required for Us to let You know how We respond to web browser Do Not Track (“DNT”) signals. DNT is a privacy preference that Users may set in their web browsers. Unless your browser or device settings are configured to make your activities invisible to usage analytics tools, We do not presently have the capability to omit You from usage analytics to the extent your browser only sends a DNT message and does not otherwise screen You from tracking without any action on Our part.
